Terms of Use

These Terms form an agreement between you and ServerGPT, the UK-based provider of the Services. ServerGPT operates from Farnham, United Kingdom. Questions about these Terms can be sent to support@servergpt.ai or through our Support page.

You must be at least 13 to use ServerGPT. If you are under the age of majority where you live, a parent or legal guardian must permit your use. If you use ServerGPT for an organisation, you confirm that you have authority to bind it. You must comply with these Terms, our Usage Policy, applicable law, Discord's rules, and the terms of any connected service.

ServerGPT provides AI-assisted tools for researching, planning, generating, editing, previewing, and syncing Discord servers; creating and editing images; building and hosting Discord bots and workflows; voice and dictation features; saved workspaces; and related community tools. Features depend on your plan and may change over time.

You control whether to use or publish an output or apply a change to Discord. You are responsible for reviewing the result, keeping appropriate backups, and deciding whether it is suitable for your community, audience, purpose, and legal obligations.

When you connect Discord, invite a bot, save bot credentials, or request a sync, you authorise ServerGPT to access the information and send the requests needed to perform that action. You confirm that you have authority to manage the relevant server and grant the requested permissions.

Discord may reject, delay, rate-limit, alter, audit, or reverse requests. We do not control Discord and are not responsible for its availability, API or policy changes, moderation decisions, permission rules, or independent processing of your data.

ServerGPT may save chat history, generated server drafts, images, bot projects, workflows, and editor state to provide your workspace and history. Current Explore features may publicly display service-generated images and their prompts, and the names, icons, or avatars of qualifying generated servers and bots. Explore copies of images may be watermarked.

Do not place confidential, sensitive, or third-party personal data in content that may be displayed publicly. To operate and promote these features, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, adapt for technical purposes, transmit, and display your content as needed to provide the Services, including displaying qualifying content in Explore. You keep the rights you otherwise have in your content. Contact support if you want us to review removal of content from Explore.

In addition to any rights you have by law, you may ask for a refund of a subscription charge, manual credit top up, or auto top up within 7 days of that charge if no credits made available by that purchase have been used and no metered generation or request has been made after the purchase. Submit the request through Support. Approved refunds are returned to the original payment method; bank or processor times may vary.

Outside this voluntary 7-day policy, charges are generally non-refundable unless the law requires a refund or we agree otherwise. This policy does not exclude or restrict statutory rights relating to cancellation, faulty digital content or services, unauthorised payments, misdescription, or any other remedy that cannot lawfully be limited. If applicable consumer law gives you a longer period or a remedy despite use, that law prevails.

Where you ask us to supply digital content or begin a digital service immediately, your statutory cancellation rights may be affected once supply or performance begins, but only where the legal conditions for that result are met. Any required consent or acknowledgement will be handled separately from these Terms.

Credits meter use of AI, images, research, bot work, server work, and other metered features. Paid-plan allowances normally refresh each billing cycle and do not roll over. The Free allocation is non-recurring unless we state otherwise. Purchased and eligible promotional credits are additional credits and may carry separate conditions. Credit cost varies with the request, model, tool use, output, image settings, and provider-reported usage.

Credits have no cash value and cannot be withdrawn or transferred. The Credit Terms form part of these Terms and explain credit ordering, top ups, promotional grants, metering, and limits in more detail.

ServerGPT can create, store, modify, register, and host bot code, credentials, configurations, and block-based workflows. You are responsible for testing behavior, permissions, packages, external APIs, moderation impact, secrets, Discord developer settings, and legal compliance before production use.

Hosting may be restarted, rate-limited, restricted, or suspended for maintenance, safety, provider limits, abuse prevention, non-payment, or operational reasons. We do not guarantee continuous uptime or compatibility with every dependency, API, Discord feature, or server configuration.

You must not misuse the Services, bypass limits or security, scrape or overload our systems, exploit bugs, use stolen payment methods, abuse free or promotional credits, or use ServerGPT for harmful, fraudulent, unlawful, or rights-infringing activity. The Usage Policy gives detailed rules and forms part of these Terms.

We and our licensors retain rights in ServerGPT, including its software, interface, branding, documentation, templates, and service-generated systems. Except for the limited right to use the Services under these Terms, no rights in ServerGPT are transferred to you.

Feedback is voluntary. If you provide ideas or suggestions, you allow us to use them without restriction or payment, provided we do not identify you publicly as the source without permission.

We may add, remove, rename, limit, or change features, models, plans, prices, credit rates, bot hosting, integrations, and beta functionality. We will provide notice where the law or your contract requires it. Third-party dependencies can also change without our control.

We provide the Services with reasonable care and skill where required by law, but do not promise uninterrupted, error-free, or permanently available operation. We may perform maintenance or apply urgent restrictions to protect users, servers, payment systems, and infrastructure.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.

If you use ServerGPT as a consumer, we are responsible for foreseeable loss caused by our breach or failure to use reasonable care and skill, but not business losses or loss caused by your failure to follow our instructions, review output, secure credentials, or keep appropriate backups. If you use ServerGPT for business purposes, then to the maximum extent permitted by law we exclude indirect or consequential loss and our total liability relating to the Services is limited to the greater of the amount you paid us in the three months before the event giving rise to the claim or £100.

You may stop using ServerGPT or delete your account through available Data Controls. We may restrict, suspend, or terminate access, remove content, preserve records, or refuse service where reasonably necessary for security, safety, fraud prevention, non-payment, legal compliance, or material policy violations.

Provisions that by their nature should survive continue after termination, including accrued payment obligations, ownership, licences already needed to operate or evidence the Services, disclaimers, liability limits, and dispute provisions.

These Terms are governed by the laws of England and Wales. Courts in England and Wales have jurisdiction, but if you are a consumer living elsewhere you keep any mandatory protections and may be entitled to bring a claim in your local courts.

We may update these Terms. We will publish the revised date and provide additional notice where a change is material or the law requires it. Changes apply prospectively from their effective date; continued use after that date constitutes acceptance where legally permitted.
